FOLLANSBEE STEEL (Follansbee) warrants to original purchaser that its micro-embossed TCS Satin, ZT ALLOY® products will be free of perforation resulting from corrosion for a period of thirty (30) years from the date of sale except when utilized within (1) mile of a marine environment. The warranty shall then be limited to a period of ten (10) years from the date of sale.

THIS WARRANTY DOES NOT APPLY IN THE EVENT THAT:

The TCS Satin product was applied over any decking material or underlay materials that have been chemically treated with material intended to retard fire in such materials, or  CCA (Chromated Copper Arsenate) or ACQ (Alkaline Copper Quaternary) treated lumber, or if the TCS Satin product involved in the warranty claim was not originally purchased directly from Follansbee or from a Follansbee distributor, dealer, or authorized representative and such purchase has not been registered with Follansbee in accordance with Follansbee's registration requirements.

The TCS Satin product was utilized for other than its intended purpose, that being sheet metal roofing and flashing.

The TCS Satin product is not properly maintained in accordance with the written maintenance standards published by Follansbee and in effect at the time the TCS Satin product was originally applied.

The foregoing warranty applies only to TCS Satin product which remains in place at the site of the original construction and is extended solely to the original purchaser and the original owner of the building to which the TCS Satin product was applied. The warranty is not transferable or assignable.

In the event of the failure of any TCS Satin product to conform to the foregoing warranty, from the date of sale of the TCS Satin product, Follansbee must be notified in writing within thirty (30) days of discovery of such failure and given adequate identification of the date of application of the TCS Satin product involved, together with invoice number and date of shipment. Failure to provide Follansbee with such notice and documentation shall void the warranty.

Purchaser's or owner's sole and exclusive remedy against Follansbee, and Follansbee's sole obligation for any and all claims, whether for breach of contract, warranty, Tort (including negligence) or otherwise, shall be limited to furnishing new product in place of the old product, F.O.B. Follansbee's plant, and shall be based on a prorated length of service factor. Follansbee shall not in any event be liable for the labor cost to replace defective product nor for faulty application of TCS Satin product by third parties in either the original or any replacement application. Follansbee shall not be liable for any special, indirect or consequential damages arising from any claims arising hereunder.

THE FOREGOING WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OF IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERHCANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
