FOLLANSBEE STEEL (Follansbee) warrants to its purchaser or to the original owner its Commercial Roofing Grade TERNE II product to be free of defects in workmanship and material for a period of thirty (30) years after shipment from Follansbee's plant, provided that the TERNE II product was installed in accordance with sheet metal industry standards and is utilized for its intended purpose, that being skin metal roofing and flashing.
THIS WARRANTY DOES NOT APPLY IN THE EVEN THAT:
1. The TERNE II product was applied over a salt or chemically treated lumber deck, such as ACQ (Alkaline Copper Quaternary).
2. The TERNE II was subject to underside moisture either from roof leakage or condensation resulting from inadequate ventilation.
3. Corrosive type fluxes were used in soldering roof panels and/or soldering was accomplished with other than copper soldering irons.
4. The TERNE II was applied over roofing felts or any type of underlay other than resin paper.
5. The TERNE II metal product involved in the warranty claim was not originally purchased directly from Follansbee or from a Follansbee authorized distributor or dealer.
6. The TERNE II metal product involved is not properly maintained in accordance with written maintenance standards published by Follansbee and in effect at the time the TERNE II product was originally applied.
7. The TERNE II metal product involved was not painted with the Follansbee RAPIDRI® paint system as outlined in Follansbee's product data manual.
8. Factory warranty; registration card was not completed and returned to Follansbee in a timely manner.
The foregoing warranty applies only to TERNE II product which remains in place at the site of original construction, and is extended solely to the original purchaser and to the original owner of the building on which the TERNE II product was applied. This warranty is not transferable or assignable.
In the event of the failure of any TERNE II product to conform to the foregoing warranty within thirty (30) years from the date of the shipment of the TERNE II product from Follansbee's plant, Follansbee must be notified in writing within thirty (30) days of discovery of such failure and given adequate opportunity to inspect the product involved in the claim, and adequate documentation of the date of application of the TERNE II product involved, together with invoice number and date of shipment. Failure to provide Follansbee with such notice and documentation shall void warranty.
Purchaser's or owner's sole and exclusive remedy against Follansbee, and Follansbee's sole obligation, for and and all claims, whether for breach of contract, or warranty, Tort (including negligence) or otherwise, shall be limited to furnishing new product in place of the old product. F.O.B. Follansbee's plant, and shall be based on a pro-rated length of service factor. Follansbee shall not in any event be liable for the labor cost to replace the defective product, nor for faulty application of the TERNE II product by third parties in either the original or replacement application. Follansbee shall not be liable for any special, indirect or consequential damages arising from any claims arising hereunder.
THE FOREGOING WARRANTY IS EXCLUSIVE AND IN LEIU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABLITY OR FITNESS FOR A PARTICULAR PURPOSE.

FOLLANSBEE STEEL (Follansbee) warrants to its purchaser or to the original owner its Residential Roofing Grade TERNE II product to be free of defects in workmanship and material for a period of twenty-five (25) years after shipment from Follansbee's plant, provided that the TERNE II product was installed in accordance with sheet metal industry standards and is utilized for its intended purpose, that being skin metal roofing and flashing.
THIS WARRANTY DOES NOT APPLY IN THE EVEN THAT:
